TERMS AND CONDITIONS

§ 1 Scope of Application

These Terms and Conditions apply to all orders placed through the online shop of:

These Terms and Conditions apply to both consumers and business customers unless expressly agreed otherwise.

§ 2 Conclusion of Contract

The contractual partner is Hoof & Care GmbH, represented by its Managing Director, Elisabeth Pikhart.

§ 3 Prices and Payment Terms

The presentation of products in the online shop does not constitute a legally binding offer but rather an invitation to place an order.

By clicking the button “Place Order with Obligation to Pay” or a comparable button, you submit a binding order.

After we receive your order, you will receive an automatic order confirmation by email.

The purchase contract is concluded once we accept your order, dispatch the goods, or expressly confirm the order.

§ 4 Prices

All prices in the online shop are stated in euros and, unless otherwise indicated, include the applicable statutory value-added tax (VAT).

Additional shipping costs may apply. These will be displayed during checkout before the order is completed.

For deliveries to countries outside the European Union, particularly Switzerland, additional import duties, customs fees, or taxes may apply. These costs are not collected by us and must be borne by the customer.

§ 5 Payment

The available payment methods are displayed during checkout.

Unless expressly agreed otherwise, payment is due immediately upon placing the order.

Different payment terms may be agreed upon for B2B customers, retailers, or resellers. These apply only if they have been expressly confirmed by us or are specified in the respective B2B account.

§ 6 Delivery and Shipping

Delivery will be made to the delivery address provided during the ordering process.

We process orders as quickly as possible. Delivery times depend on the destination country, the selected shipping method, and the respective shipping carrier.

Any delivery times stated are non-binding unless a fixed delivery date has been expressly agreed upon in writing.

§ 7 Shipping Costs

Shipping costs are displayed during checkout and depend on the destination country, the weight of the order, and the selected shipping method.

Free shipping may be offered for orders above a specified order value stated in the shop. Whether your order qualifies for free shipping will be shown directly during checkout.

§ 8 Retention of Title

The goods remain our property until full payment has been received.

§ 9 Right of Withdrawal for Consumers

Consumers generally have the right to withdraw from the contract within 14 days without giving any reason.

The withdrawal period is 14 days from the day on which you, or a third party designated by you who is not the carrier, acquired possession of the goods.

To exercise your right of withdrawal, you must inform us of your decision to withdraw from the contract by means of a clear statement, for example by email:

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

§ 10 Consequences of Withdrawal

If you withdraw from the contract, we will reimburse all payments received from you, including the standard delivery costs, no later than 14 days from the day on which we receive notification of your withdrawal.

For the reimbursement, we will use the same payment method that you used for the original transaction, unless expressly agreed otherwise.

We may withhold reimbursement until we have received the goods back or until you have provided proof that you have returned the goods, whichever occurs first.

You must return or hand over the goods to us without undue delay and, in any event, no later than 14 days from the day on which you informed us of your withdrawal from the contract.

The direct costs of returning the goods shall be borne by the customer.

§ 11 Exceptions to the Right of Withdrawal

The right of withdrawal does not apply, or may expire prematurely, for goods that have been manufactured according to customer specifications or are clearly tailored to personal needs.

Opened or used care products can only be returned for hygiene reasons if this is required by law or if the goods are defective.

§ 12 Inspection of Goods and Compensation for Diminished Value

You may inspect the goods to the extent that would be possible in a retail store.

If the goods lose value due to use beyond what is necessary to examine their nature, characteristics, and functioning, we may claim reasonable compensation for the diminished value.

§ 13 Warranty

The statutory warranty rights shall apply.

If a product is defective, please contact us at office@hufoel.at and, if possible, send us photos along with your order number. We will review the case and find an appropriate solution.

§ 14 Product Information

Our products are care products for animals. The product descriptions and instructions for use are provided for general information purposes only and do not replace veterinary diagnosis or treatment.

In cases of unclear, severe, worsening, or painful hoof or skin conditions, a veterinarian or other qualified professional should always be consulted.

§ 15 Use and Compatibility

Our products must be used in accordance with the respective instructions for use.

As every animal may react differently, we recommend testing new products carefully on a small area first.

If any adverse reactions occur, discontinue use immediately.

§ 16 Vouchers and Discount Codes

Vouchers and discount codes may only be redeemed within the specified period and subject to the applicable terms and conditions.

They cannot be applied retroactively to orders that have already been completed.

Discount codes cannot be combined with other promotions unless expressly stated otherwise.

§ 17 B2B Customers and Retailers

Special prices, minimum order quantities, payment terms, and delivery conditions may apply to business customers, retailers, and resellers.

These special conditions apply only if they have been expressly agreed upon or are specified in the respective B2B account.

§ 18 Liability

We shall be liable without limitation for damages resulting from injury to life, body, or health, as well as for damages caused by intent or gross negligence.

In cases of slight negligence, we shall only be liable for breaches of essential contractual obligations and only for damages that are typically foreseeable, to the extent permitted by law.

Liability under mandatory statutory provisions shall remain unaffected.

§ 19 Data Protection

Information on the processing of personal data can be found in our Privacy Policy.

§ 20 Governing Law

Austrian law shall apply, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).

For consumers, this choice of law shall apply only to the extent that it does not deprive them of the protection afforded by mandatory provisions of the law of the country in which they have their habitual residence.

§ 21 Place of Jurisdiction

For business customers, the place of jurisdiction shall, to the extent permitted by law, be the registered office of our company.

For consumers, the statutory places of jurisdiction shall apply.

§ 22 Online Dispute Resolution

Consumers have the option of submitting complaints via the European Commission’s Online Dispute Resolution (ODR) platform:

We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

§ 23 Final Provisions

Should individual provisions of these Terms and Conditions be wholly or partially invalid, the validity of the remaining provisions shall remain unaffected.
